*NEW ILLINOIS POWER OF ATTORNEY ACT – REVISED HEALTH CARE AND PROPERTY POWER OF ATTORNEY FORMS ARE HERE!!!

Last summer, the Illinois legislature passed a bill revising the Illinois Powers of Attorney for Property and Health Care. Such law goes into effect on July 1, 2011.

The new Power of Attorney forms (Property and Health Care) were drafted to make such forms more readable and understandable than the predecessor forms. In particular, for the Health Care Power, the new law significantly alters the second available option for directing how an agent shall act with regard to life-sustaining treatment, which may better suit the needs of some clients.

All Clients should have Health Care and Property Powers of Attorneys in place.

Furthermore, for those with existing Powers of Attorney, it may be advisable to execute new documents using the updated forms.

This is an article describing in detail the important adoption by the Illinois legislature of the “Illinois QTIP Election” for 2009 and future years. This estate planning technique permits optimal funding of the credit shelter trust for federal estate tax purposes, without incurring Illinois estate taxes in the estate of the first spouse to die. Technical complexities abound in implementation and administration of this technique.
